Despite pandemic, Trump administration urges end to ACA

Close to half a million people who lost their health insurance amid the economic shutdown to slow the spread of COVID-19 have gotten cove

Dismantling the ACA would leave more than 23 million people without healthcare plans, according to a recent analysis by the liberal-leaning think tank Center for American Progress.

Yet on Thursday, the Trump administration urged the Supreme Court to throw out the ACA because two self-employed Texans assert that the law injures them.

In April and May alone, almost half a million Americans sought coverage through a special enrollment period that allowed Americans who experienced life changes or lost coverage as a result of the coronavirus crisis to apply for coverage under the ACA, according to a Department of Health and Human Services report released this week.

"No further analysis is necessary; once the individual mandate and the guaranteed-issue and community-rating provisions are invalidated, the remainder of the ACA can not survive", the Justice Department stated in its brief.

In a filing with the Supreme Court on Thursday, the Trump administration asked to have Obamacare invalidated on the grounds that Congress eliminated the individual tax penalty for failing to purchase medical insurance.

"Nothing the 2017 Congress did demonstrates it would have intended the rest of the ACA to continue to operate in the absence of these three integral provisions", Francisco said.

For his part, the Attorney General argues in his appeal filed Thursday evening that "the individual mandate is not separable from the rest of the law".

Presumptive Democratic presidential nominee Joe Biden rebuked the administration for its "cruel" and "heartless" filing during a speech in Pennsylvania.

The Democratic Speaker of the House of Representatives, Nancy Pelosi, condemned the Trump administration's initiative and called it "an act of unimaginable cruelty" during the pandemic. His latest tweet comes as the administration faces criticism for its effort this week to have the Affordable Care Act (ACA) squashed amid the coronavirus pandemic.

"If Donald Trump prevails in courtroom, insurers would be permitted after once again to strip absent coverage, jack up rates, simply simply because of the battle they survived, battling coronavirus", Biden stated.

"The ACA has been life-changing and now through this pandemic, we can all see the value in having greater access to quality health care at affordable prices", he said at an event with Biden on Wednesday. "I will ALWAYS PROTECT PEOPLE WITH PRE-EXISTING CONDITIONS, ALWAYS, ALWAYS, ALWAYS!"

The Supreme Court will hear the case in its next term starting October, but US media reported that it is unlikely to be examined before the presidential election in November.
