Trump ex-adviser Flynn seeks to withdraw guilty plea - court filing

Attorneys for former national security adviser and retired Lt. Gen. Michael Flynn have filed a motion to withdraw his guilty plea from two years ago, "because of the government's bad faith, vindictiveness, and breach of the plea agreement". "He gave the prosecution his full cooperation".

The Department of Justice originally requested a probationary period for its collaboration with investigators, but urged a Washington judge on January 7 to convict him of six months in prison for apparently not repenting his crimes.

Prosecutors had earlier said Flynn was entitled to avoid prison time because of his extensive cooperation, but they changed their view after he hired new lawyers who leveled accusations of misconduct against the government.

Powell said she and Flynn's other representatives "pushed back" against federal prosecutors by presenting them with evidence "for hours showing them all kinds of different things that supported the fact that he was telling the truth".

Flynn was one of several former Trump aides to plead guilty or be convicted at trial in Mueller's investigation that detailed Moscow's interference in the 2016 USA election to boost Trump's candidacy, as well as numerous contacts between Trump's campaign and Russian Federation.

"He endured massive, unnecessary, and frankly counterproductive demands on his time, his family, his scarce resources, and his life", they added.

He cooperated extensively with the government over the next year.

Tuesday's filing by Mr Flynn's lawyers asked Judge Sullivan to postpone that sentencing date.

The Justice Department opted not to have Flynn testify in the Virginia trial of a former business associate, saying that shortly before trial, he changed his account and contradicted his own past statements - making him unreliable as a witness.

In the court filing a complaint on Tuesday, Flynn's lawyers cite the "bad faith, revenge and violation of the case" for the decision to withdraw his case.
