Govt decides to not take immediate action against judge Arshad Malik

The government has made a decision to not take an immediate action against accountability judge Arshad Malik following a controversy revolving around the "leaked" video tape.

Verdicts in both corruption references were announced by an accountability court judge Arshad Malik. However, in a press statement the following day, the judge refuted the accusation and dubbed the video as a "conspiracy hatched to affect his credibility". "However, when I spoke up, I politely tried to explain to Mian Nawaz Sharif that the conviction in the HME Reference was on merit and that there was substantial evidence adduced against him by the prosecution which had gone unrebutted in defence, whereas, in the Flagship reference he was acquitted because of the absence of the required level of evidence", the judge alleged in the affidavit.

"Nasir Janjua claimed that he had the cash of equivalent of Rs100 million in Euros for me immediately available out of which the Euro equivalent of Rs20 million was laying in his auto parked outside", he said, adding that he denied the bribe while remaining committed to giving the verdict on merit. She asked why her father was not being released if the judge who had given the verdict in the case against him was removed.

He said that later in 2019, he met with Khurram Yousaf and Nasir Butt, who told him about the existence of a video clip of him in a compromising position which was allegedly taken during the time he was working in Multan.

The judge said Nasir Janjua had claimed that he had about Rs100 million in euros as advance payment of which Rs20 million was in the auto he had arrived in. Sources said Malik had failed to convince the chief justice with his answers regarding the video controversy.

The judge, elaborating the April 6 meeting in the affidavit, further wrote that he had accompanied Nasir Butt to Jati Umra where Nawaz "personally received" them. "Nawaz was obviously displeased by my response", he added.

"The judge further claimed that he was blackmailed after being shown the video" and told to record an audio message that he delivered the verdicts to appease the "ruling elite" under an vast pressure and that substantial evidence was not available against the former prime minister.

Former Pakistan prime minister Nawaz Sharif with his daughter Maryam Nawaz. "The matter is about removing the verdict, which this judge had given under pressure, from the court record", she said.

On December 24, 2018, the Pakistan Muslim League-Nawaz (PML-N) supreme leader and former prime minister Nawaz Sharif was sentenced to seven years in prison in Al-Azizia reference case by an accountability court.

In this respect, the court has issued notices to the PML-N Vice President Maryam Nawaz, former prime minister Shahid Khaqan Abbasi, Raja Zafarul Haq and others. In a series of posts shared on Twitter, Maryam said the matter was not about the removal of a judge but about suspending the verdict that the judge had issued. "If this is the case, how can a verdict by this judge be maintained", she asked. He also requested the court to initiate contempt of court proceedings against Maryam Nawaz if her allegations found to be untrue.
