Former Nissan chairman Carlos Ghosn's re-arrest means he could be detained for another 10 days

A Japanese court has denied prosecutors' request to extend the detention of former Nissan chairman Carlos Ghosn, who has been charged with under-reporting his pay. They could still take further legal steps in a bid to allow them to investigate Ghosn and co-defendant and former Nissan executive Greg Kelly longer.

Other lawyers such as Tsutomu Nakamura, a former public prosecutor who is the founder of Nakamura International Criminal Defense in Tokyo, suggested that the court decision doesn't necessarily mean Ghosn may walk out of jail immediately.

It said it had also decided against extending detention for Greg Kelly, a former Nissan executive who was arrested along with Ghosn on November 19. Prosecutors allege Ghosn's pay was underreported by a total of almost 10 billion yen ($80 million).

Tokyo prosecutors last week added a second allegation that they also under-reported another four billion yen ($36bn) in Ghosn's pay for the period 2016-2018, for which their first 10-day detention was to expire later on Thursday.

Including the re-arrest suspicion, the two are alleged to have under-reported a total of 9.1 billion yen ($81 million) over the eight-year period. Carlos Ghosn's lawyers said they plan to apply for bail, and the vehicle titan could be out as soon as Friday if the request is approved. Saikawa has emerged as a driving force in the investigation about the alleged wrongdoing by Ghosn and Kelly.

Mr Ghosn's detention has also put into doubt the future of the Alliance - a global auto manufacturing group that includes Renault, Nissan and Mitsubishi.

Mitsubishi - like Nissan - has stripped Mr Ghosn of his role as its chairman.

And in another unexpected development, Ghosn was arrested on Friday on suspicion of transferring losses from personal financial investments to Nissan, causing damage to the company's assets, according to a statement from prosecutors.

The scandal has shaken the partnership between Nissan, Renault and Mitsubishi Motors, with Saikawa calling for changes to weaken Renault's control over Nissan.

Disagreements within the world's biggest automotive alliance that was spearheaded by Ghosn have all but exploded since his arrest.

Nissan on Thursday said Saikawa earlier this week held a one-on-one meeting with Renault acting boss Thierry Bollore, saying Saikawa described the meeting as "positive". "I didn't make such an explanation and think you should not think of it that way".
