Brexit: Court Begins Legal Bid To Prevent Boris Johnson's Government Shutdown

According to reports on Monday, Downing Street believes rebel MPs will try to make a move to stop a no-deal Brexit in the second week of September, with the European Union unlikely to respond until after that battle has played out.

But more than 70 MPs and peers have launched a legal bid, asking that the Court of Session in Edinburgh rules it "unlawful and unconstitutional" to prorogue, or suspend, Parliament as an attempt to stop MPs blocking a no-deal Brexit.

The case had its first court outing on Tuesday at which the Court of Session decided that a substantive hearing would take place on September 6, said lawyer Jo Maugham from the Good Law Project which is supporting the challenge.

The Telegraph revealed today that Labour MPs have been told to cancel all travel in the first two weeks of next month.

Walsh argues, "This raises the startling prospect that, unless an extension to Article 50 is sought and secured, a no-deal Brexit could take place in the middle of an election campaign".

That's the so-called "no deal" option, which, unless there's a last minute compromise, will happen on the 31st of October.

Some expect 9 September to be the first opportunity for a legislative battle, as the Government is bound in law to provide a report updating on Northern Ireland on 4 September and to then debate it in Parliament for five days.

British Prime Minister Boris Johnson spoke to US President Trump on Monday, discussing Brexit, trade and economic issues, a statement from Johnson's office said.

A group of about 70 lawmakers from opposition parties are backing a bid to have Scotland's highest civil court rule that Johnson can not ask Queen Elizabeth to prorogue, or suspend, parliament before Britain leaves the European Union on October 31.

On Monday, U.S. national security adviser John Bolton said the United States would enthusiastically support a no-deal Brexit if that was the British government's decision and Washington was ready to work fast on a U.S. -UK trade agreement.

He added: "To be clear, in the Trump administration, Britain's constantly at the front of the trade queue, or line as we say".

He said: "You could do it sector by sector, you could do it in a modular fashion, in other words". So the objective is either one document or a series of agreements that would be comprehensive.

"We discussed trade, security, and opportunities to deepen our bilateral relationship after the United Kingdom leaves the EU".

"We're very clearly focused as a government that we want to get a deal".
