Ashley Judd harassment case against Weinstein thrown out by judge on technicality

A judge has dismissed one section of Ashley Judd's lawsuit against Harvey Weinstein but the rest remains headed toward trial

She accused Mr Weinstein of defaming her in 1998 after she refused what she said were his sexual advances during a meeting at a hotel in late 1996 or early 1997.

She claimed he further blacklisted her from other movie roles, too, and eventually sued him under the legal theory of "sexual harassment in a professional relationship".

"Nothing about today's ruling changes that Ms. Judd's case is moving forward on multiple claims", Theodore Boutrous Jr., the lead lawyer representing Judd's case, said in a statement reported by The New York Times Wednesday.

After the ruling, the "Double Jeopardy" actress' attorney made it clear that the decision in no way meant his client's lawsuit against Weinstein was over, and that they would be proceeding with her multiple claims.

"Ms Judd was hired for not one, but two of Mr Weinstein's movies, Frida in 2002 and Crossing Over with Harrison Ford in 2009".

Judd's suit was filed in April. About a year later, Judd claims, Weinstein badmouthed her to director Peter Jackson, who had been considering her for a role in the Lord of the Rings trilogy.

Gutierrez said Judd's allegations of defamation and economic interference can continue. Her sexual harassment lawsuit was re-filed following a change in California state law after her initial claim was rejected by Judge Gutierrez in a Los Angeles federal court last September.

The judge ruled that Ashley and Harvey's relationship did not fall within that law and that a producer-actress relationship is not covered under that law.

"The burden on Weinstein has the potential of being dramatically and unfairly negative if the stay is denied".

"We look forward to pursuing the three claims for relief that the Court has already ruled can move forward", he also said.

Weinstein's lawyer, Phyllis Kupferstein, responded by saying they saw future wins against Judd, in a statement to CNN: "We have said from the beginning that this claim was unjustified, and we are pleased that the court saw it as we did".

Guiterrez's ruling on Judd's sexual harassment claim agrees with a previous ruling in July, which likewise determined that California law didn't apply, USA Today notes. Since then, more than 80 women have accused Weinstein of varying degrees of misconduct, including harassment and rape.

Weinstein is to stand trial in May in NY on five charges, including rape, involving two other women. In October of 2017-just before the resurgence of the viral #MeToo movement-she recounted the accusations again, this time naming Harvey Weinstein as that mogul.
