Kavanaugh in memo argued against indicting sitting president

Brett Kavanaugh

Chuck Grassley, R-Iowa, said in a statement Friday.

The hearings for President Trump's pick to replace retired Justice Anthony Kennedy will be held September 4 to 7, according to a notice sent to Senate Republican offices Friday and obtained by the Washington Post, although the committee noted that the hearing could be three or four days. Questioning will begin the following day. But thousands of pages - which are a fraction of all the documents from Kavanaugh's tenure as Bush's associate White House counsel - that have already been given to the committee are still considered "committee confidential", which means no one outside the panel's senators and staff can review them. He wrote, "We believe an indictment should not be pursued while the President is in Office". "Judge Kavanaugh looks forward to addressing the Judiciary Committee in public hearings for the American people to view", White House spokesman Raj Shah said in a statement Friday following the announcement. But Democrats want access to more documents from Kavanaugh's past as a judge and as an official in the George W. Bush administration.

He further touted the nominee as a mainstream judge with a record of "applying the law as it is written".

The Judiciary Committee will hold up to four days of review, with Kavanaugh to begin facing questions on Day 2, September 5, said committee chairman Sen.

Sen. Chuck Grassley, the Republican chairman of the Judiciary Committee, says the committee will launch up to four days of review that Tuesday, beginning with opening remarks from senators.

"At this current pace, we have plenty of time to review the rest of emails and other records that we will receive from President Bush and the National Archives", he said.

Democrats, led by Senate Minority Leader Chuck Schumer of NY and Sen. The committee acknowledged that the Bush screening team decided which records to disclose for public review, a move panned by Democrats. John McCain has been receiving cancer treatment in his home state, Republicans can not afford to lose any votes and hope to advance Kavanaugh's nomination if no Democrats support him.

"Republican efforts to make this the least transparent, most secretive Supreme Court nomination in history continue", Schumer said. "They seem to be more frightened of this nominee's record and history than any we've ever considered".

Kavanaugh was nominated on July 9 and since then, the committee has received 184,000 pages of records related to his work as a White House lawyer and for his work with Independent Counsel Kenneth Starr. "This is not how the Senate should approve a nominee for a lifetime appointment to the highest court in the land", said Sen.
