Trump intends to nominate Judge Brett Kavanaugh to Supreme Court

Mike Lee received a phone call Monday from President Donald Trump telling him he would not be his nominee for the U.S. Supreme Court, the Deseret News has learned.

The announcement came hours before Trump is due on Monday night to name his pick to replace Justice Anthony Kennedy, marking an official start to a massive debate in the Senate on the future of the Supreme Court.

"The president was going to change and the people were going to have the opportunity in November to vote on the premise that the next president is going to be appointing a Supreme Court Justice", she said.

The president also has been considering federal appeals court Judges Raymond Kethledge and Thomas Hardiman. But the situation appeared to remain fluid. Trump signed Kavanaugh's nomination papers Monday evening in the White House residence.

Kavanaugh has come under fire in some conservative circles for his ties to Bush, a member of the Republican establishment that is eschewed by Trump, as well as for not sometimes ruling aggressively enough on issues of importance to conservative activists. The court's senior liberal justice, Ruth Bader Ginsburg, is 85. At the top of that list is abortion.

Liberal groups have geared up to protect Roe v. Wade, the Supreme Court case that upheld women's rights to an abortion, from being overturned.

While the USA president has been pondering his choice, his aides have been preparing for what is expected to be a tough confirmation fight.

Republicans hold a slim 51-49 majority in the Senate, though with ailing Senator John McCain battling cancer in his home state of Arizona they now can muster only 50 votes.

Kyl has a wealth of experience in the Senate, which will be needed as the president's nominee is expected to face an intense confirmation battle.

The nomination is Trump's second to the nation's highest court, a rare presidential privilege that could seal a key part of Trump's legacy less than two years into his first term.

Joe Donnelly of Indiana, Heidi Heitkamp of North Dakota and Joe Manchin of West Virginia will be prime targets.

It took three years before the Senate voted to confirm him for that role, however. Susan Collins of ME and Lisa Murkowski of Alaska, to oppose any nominee who threatens Roe v. Wade. The two have supported access to abortion services.

Leo said, however, that ultimately Trump would succeed at lining up conservative support for anyone he selected.

A nominee needs a simple majority of 51 votes to be confirmed.

He also served in the U.S. House of Representatives. He went to the University of Notre Dame as the first person in his family to go to college. Kavanaugh and Gorsuch served as law clerks to Kennedy at the same time early in their legal careers.

Barrett - a longtime Notre Dame Law School professor who became a federal appeals judge last fall - excited social conservatives with her testimony when questioned about her Roman Catholic faith in her nomination hearings a year ago.
