Supreme Court upholds travel ban in major win for Trump

President Trump said the Supreme Court's decision to uphold the administration's travel ban was a "tremendous victory" for the country and constitution after Justices ruled 5-4 in the White House's favor. On immigration and national security matters, the court has historically deferred to the executive branch of government. Venezuela and North Korea also were targeted in the current policy. It originally included travelers from Chad, but those restrictions were lifted in April after the USA determined that Chadian officials had "sufficiently improved" the country's performance on passport and border controls.

There have been three different versions of this travel ban since the presidential order was first attempted 17 months ago. Both these judges said Trump's anti-Muslim comments were proof that the ban was biased against Muslims and immigrants.

"We express no view on the soundness of the policy", Chief Justice Roberts wrote. She added that the five justices who approved the ban also turned "a blind eye to the pain and suffering the proclamation inflicts upon countless families and individuals, many of whom are US citizens". Attorney General Jeff Sessions praised the ruling saying that although the administration has been respectful of lower courts and legal opinion, they do not get to set policy.

President Donald Trump's supporters say the Supreme Court's Decision validated those concerns and may have triggered a different conversation.

"The president lawfully exercised that discretion based on his findings - following a worldwide, multi-agency review - that entry of the covered aliens would be detrimental to the national interest", Roberts wrote. Justice Roberts actually sidestepped the question about whether this was largely motivated by anti-Muslim animus as telegraphed by the president during his campaign when he called for an outright ban on Muslim.
