Supreme Court justice's retirement is a gift for Donald Trump

Justice Anthony Kennedy 81 often has been a swing vote on the Supreme Court

But instead of celebrating publicly, some evangelical leaders are downplaying their fortune on an issue that has defined their movement for decades.

In so doing, the majority opinion - in an unusual move, written by not one but three justices, including Kennedy - introduced the "undue burden" test, which asserted that a state can not make laws that impose "substantial obstacle in the path of a woman seeking an abortion before the fetus attains viability".

CNN legal analyst Jeffrey Toobin was typically blunt, declaring within minutes of the news that abortion would be outlawed in almost half the USA within 18 months.

A federal appeals court judge in Washington was the early favorite among political bettors to succeed U.S. Supreme Court Justice Anthony Kennedy, who announced his retirement on Wednesday.

And while these are the very best of times for the religious right, social conservatives risk a powerful backlash from their opponents if they cheer too loudly. Gorsuch was regarded and has voted as a reliable conservative, helping to maintain the court's ideological makeup.

"Roe v. Wade is doomed", he added. John Boozman, R-Ark. "I thank him for his service to our nation and his commitment to upholding the rule of law throughout his tenure on the highest court in the land".

Following are just some of the possible nominees mentioned by various political groups and media outlets following Kennedy's announced retirement.

He called Kennedy a "spectacular man" with "tremendous heart" and said he hoped to pick somebody who will be as "outstanding" as Kennedy has been.

Control over Supreme Court nominations has become a hot-button issue for the U.S. electorate, with 70 percent of respondents in a 2016 CNN poll saying it was an important factor in their vote. "I find it hard to think that [Chief Justice] Roberts - who has a more long-term view of the arc of the court and a desire to preserve its institutional role - would facially overrule Roe".

Now, with the retirement of Supreme Court justice Anthony Kennedy on Wednesday, the true magnitude of Trump's victory has come into clearer focus than ever before. With this next nomination, he could turn the Supreme Court to the right for a generation, she said on CBSN.

Despite Trump's struggles with Christian values in his personal life at times, skeptical evangelical Christians lined up behind him in the 2016 election, and they remain one of his most loyal constituencies.

Trump told reporters the process would "begin immediately".

Kennedy has always been a key swing vote, so Trump's selection could tilt the court in a more conservative direction for years to come. Trump promised he would. Will they have the nerve to reject a justice akin to Neil Gorsuch, who has proved to be dogmatically conservative? However, he invited her, Donnelly and Manchin to the White House the next day to discuss the nomination process. The White House said Trump's team also spoke with more than a dozen additional senators.

That change of heart is reflected in surveys of Americans' values: In 1994, two years before Romer v. Evans, 49 percent of Americans said homosexuality should be discouraged by society, according to the Pew Research Center.

Trump's ability to nominate Kennedy's successor infuriates liberals already upset by the court's latest rulings - and animates conservatives who'll demand another justice in the Gorsuch mold.

He'll take a look at a list of 25 potential nominees that was assembled with the help of conservative interest groups.

In her dissent to the majority's ruling on the travel ban, Sotomayor compared the decision to the Korematsu v.

President Trump celebrated the ruling as a "profound vindication" of his immigration policies, which have drawn significant backlash for years, dating back to the first moments of his presidential campaign. "Many of them voted on this issue alone", Falwell said.
