Pizza delivery man facing U.S. deportation order granted stay

A federal judge on Saturday temporarily blocked the deportation of a NY pizza shop worker to his native Ecuador after he was arrested while making a delivery to a Brooklyn Army base.

He ended up "signing a waiver permitting a background check", which revealed there was an active warrant for Villavicencio's deportation and prompted military police to call immigration agents, the base and Immigration and Customs Enforcement said.

Jennifer Williams, Villavicencio's Legal Aid Society lawyer, said at a news conference Friday that she filed a motion to stop his removal and to allow Villavicencio to pursue legal residency through his wife, who is a USA citizen.

Pablo Villavicencio was detained when he made a delivery to Fort Hamilton army base on Friday and was asked for a second form of ID.

"I don't know if it's going to be good or not to tell them the truth". "I confirmed with her that New York State, working with our partners, has secured pro-bono legal counsel to represent Mr. Villavicencio", he added in a separate tweet.

Redmond Haskins, a spokesman for The Legal Aid Society, a not-for-profit organization that provides free services to clients who can not afford them, said Villavicencio has no criminal record. While the governor has promised free legal representation to Villavicencio, representatives from both the Legal Aid Society and Make The Road NY say that support has not yet materialized.

Man detained after NYC pizza delivery granted emergency stay

"They treated me like a criminal".

Villavicencio, the father of two little girls who were born in the United States, came to the USA a decade ago. "Now, I'm alone with two kids". "He should be immediately released from ICE custody and an investigation should be launched into the circumstances of his arrest".

In a letter to the ICE office in New York, New York Gov. Andrew Cuomo said Villavicencio's "expedited removal serves no legitimate public safety goal and the circumstances leading to his arrest and detention raise serious legal and policy concerns".

According to an ICE spokesperson, the pizza delivery man was ordered by a judge to leave the country in 2010, and has been a "ICE fugitive" ever since. As a result, his voluntary departure order became a final order of removal, Immigration and Customs Enforcement said.

"He was a tax-payer, contributor to our community entering this base, and now he went from being in this base - that's here to protect us - to prison", Brooklyn Borough President Eric Adams said. Unable to show the guard anything but a city identification card, his wife says the guard then contacted ICE officials who detained him.

'Is our city or our nation any safer now that Pablo the pizza delivery man is off the streets?' Brannan asked.
