Ennis, who testified against the advice of her attorney Stephanie Rickard, said she made up the story because she wanted to ruin Foster's career and sue him for money after he broke up with her on the morning of February 11.

Elissa Ennis testified she lied because she wanted retribution after Foster tried to end their relationship, saying she was angry "and I wanted to end him". I wanted him t go down.

49ers GM John Lynch previously stated Foster would be released if the allegations were true, but it looks like he will be able to get back to football.

She repeatedly said she couldn't fully remember what she told police - statements which ultimately led to the criminal charges against Foster. "I was pissed", Ennis said, via the San Jose Mercury News.

And Ennis' choice to testify Thursday was against the advice of her attorney. Los Gatos-Monte Sereno Police Department detective Jason Wiens testified there was no evidence that Ennis and Foster had communicated between her accusations and the first time she told authorities that she had lied about Foster.

San Francisco took Foster with the No. 31 overall pick in the 2017 NFL Draft, but there were plenty of red flags surrounding him.

The domestic violence charge is the most serious, but Foster is also awaiting a verdict on a gun charge, which could potentially be dismissed to a misdemeanor.

Rather, Klippen will determine if there's enough probable cause to send the case to trial, at which point it appears unlikely, beyond reasonable doubt, the prosecution can prove enough to convict Foster after Ennis recanted her story.
