BS Yeddyurappa resigns before facing floor test. With an eye on the 2019 Lok Sabha polls, the first decision of the new Chief Minister B S Yeddyurappa was to reach out to farmers of Karnataka.
The petition was filed by the Congress-JD (S) along with the main petition wherein they asked to stay the swearing-in of Yeddyurappa as the Chief Minister of the state.
After a almost three-and-a-half-hour hearing beginning 2:11 AM, a three-judge apex court bench made it clear that the provisional swearing-in and the government formation would be subject to the final outcome of the case before it.
The apex court asks on what basis the governor decides who can provide stable government- the single largest party or a coalition party with majority.
The Congress hopes this will put sufficient pressure on the judiciary that two different laws can not possibly be applied to identical situations.
Government formation in Karnataka has been a muddled affair with the Karnataka Assembly election results 2018 throwing up a hung Assembly, giving 104 seats to the Bharatiya Janata Party (BJP), 78 seats to the Congress and 37 seats to the JD (S).
Chaudhary was one of the senior advocates, appearing along with senior counsel Abhishek Manu Singhvi, for the Congress-JD (S) combine. The 15-day window given to BJP to prove its majority was also deliberated upon, but the court refused to modify it, for now.

Yeddyurappa, who was sworn in as the chief minister of Karnataka yesterday, argued that the BJP as the single largest party had the "mandate of people", who had thrown out the Congress.

As the Congress tried to fly its lawmakers out of Karnataka fearing defection to the BJP, three chartered flights were denied permission to take off from Bengaluru this evening, sources in the aviation watchdog DGCA said. The JD (S) was making similar preparations for its legislators.
Rohatgi told the bench that there was no pre-poll alliance between the Congress and JD (S) and they have formed an "unholy alliance" after the elections. JD (S) leaders joined the protest. In this case, as Mr Yeddyurappa is yet to undertake the floor test, he does not have the legal, moral or constitutional authority to advise the governor to exercise his power under Article 333.
"For the BJP, while an outright win would have been ideal, the current numbers are still a positive and critical indicator of their standing", Kumar said.
Rohatgi also said that there was no need for Yeddyurappa to give names of all MLAs who were supporting him to Governor and he was ready to prove majority any time.
