North Dakota Joins Lawsuit Against Drug Maker Purdue Pharma

The lawsuit says Purdue pushed a message of "pseudo-addiction", marketing the idea that people engaged in drug-seeking behavior because they were not receiving enough opioids, and attempted to discredit non-opioid pain relievers by saying medications like aspirin or acetaminophen are riskier for chronic pain.

At a press conference today, Attorney General Ken Paxton announced that his office filed a consumer protection lawsuit in Travis County District Court against Purdue Pharma for violating the Texas Deceptive Trade Practices Act (DTPA) involving the company's prescription opioids, including OxyContin.

Starting a year ago, Attorney General Paxton and a bipartisan group of 40 other state attorneys general have been conducting an investigation into whether companies that manufacture and distribute prescription opioids engaged in unlawful practices.

Slattery III and a bipartisan group of attorneys general have filed a lawsuit against Purdue Pharmaceuticals for their alleged unlawful marketing of OxyContin and other drugs that have caused and prolonged the opioid epidemic in the state. Also, Nevada and the other litigating states continue to engage in ongoing settlement discussions with Purdue and other companies.

In a statement, Connecticut-based Purdue Pharma denied the claims and said the company will defend itself. Company spokesman Bob Josephson said the civil lawsuits followed months of negotiations with state officials to address the opioid crisis.

The state alleges that Purdue made unsubstantiated claims regarding the benefits of long-term opioids treatment and falsely represented that opioid use improved patients' function and quality of life.

"Purdue is the target here because it is one of the nation's largest opioid manufacturers", Stenehjem said.

Similar lawsuits were filed in Florida, Nevada, North Carolina, Tennessee and Texas. The cases have been consolidated before a federal judge in Ohio.
