Omo-Agege Senate appeals suspension nullification

Mr Omo-Agege was suspended for 90 days by the Senate after he accused his colleagues of working against President Muhammadu Buhari by amending the electoral act.

The Federal High Court, Abuja, on Thursday, nullified the suspension of Sen.

He said "gentlemen, the task of making Nigeria great again is the patriotic duty of all Nigerians".

The judge said the senate could only have suspended him for only a period of 14 days as prescribed in its rules. Judiciary is the hope of the common man and access to court is one of the key indicators of democracy and rule of law, Justice Dimgba said.

Omo-Agege, alongside nine other Senators, had staged a walkout after the Senate passed the bill.

The court maintained that the legislature is entitled to take measures to discipline any of its members whose action is capable of bringing the institution to disrepute.

Following his suspension, Omo-Agege had headed to the court to seek redress wherein he filed a suit against the Senate (1st defendant), the Senate President (2nd defendant), and the Attorney General of the Federation (3rd).

It will be recalled that Senator Omo-Agege who is representing Delta Central Senatorial district had in his suit marked FHC/ABJ/CS/314/2018, prayed the court to quash his suspension and declare that he was illegally barred from attending plenary at the Senate.

Omo-Agege had accused the Senate of targetting President Muhammadu Buhari with the Electoral Act Amendment, especially that aspect that deals with modification of election sequence.

A Nigerian court has nullified the suspension of a senator from the country's parliament, saying the basis for penalizing the lawmaker "violently violates" the constitution. The court faulted the committee's decision to allow Melaye participate during its deliberations on the issue and the signing of its report to the Senate.

Omo-Agege who was referred to the Senate Committee on Ethics, Privileges and Public Petitions fr investigations of comments attributed to him, sued the senate asking the court to stop the committee from investigating him.
