GOP Rep. Lamborn Does Not Qualify for Primary Ballot, State Court Rules

Colorado Supreme Court rules longtime GOP Rep. Doug Lamborn ineligible for primary ballot

The court ruled Lamborn violated state rules when collecting the 1,000 GOP signatures needed to qualify for the primary ballot.

The firm Lamborn's campaign hired to handle his petition drive was also used by Republican State Treasurer Walker Stapleton.

"Republicans like Walker Stapleton and Doug Lamborn have wasted hundreds of thousands of dollars bringing out-of-state fraudsters to Colorado to collect signatures that were eventually deemed worthless", said Eric Walker, a spokesman for the party.

The court's decision comes after a Denver District Court ruling that found Lamborn should remain on the ballot despite some of the signature gatherers his campaign used possibly being out-of-state residents - something that is illegal for signature gatherers in Colorado. Lamborn initially qualified for the ballot, with 1,269 valid signatures - more than the 1,000 required.

"We recognize the gravity of this conclusion, but Colorado law does not permit us to conclude otherwise", the court wrote in its opinion. But a group of Republican activists sued, pointing out that at least one of Lamborn's petition gatherers had paid California taxes in 2017 and did not fully reside in Colorado.

Congressman Doug Lamborn visited with a standing-room-only crowd at the Fremont County Republican Central Committee meeting in January. The campaign will reportedly turn to federal court, seeking to overturn "the part of Colorado law that deprives voters who have petitioned to have Congressman Lamborn on the ballot of their Constitutional rights". "The dismissiveness with which Doug Lamborn has treated this case is indicative of the dismissiveness with which he has treated Colorado election law".

Lamborn told media he was still processing the ruling in the initial hours after it came out. Digging at Lamborn, Francisco noted, "It's a pity that Mr. Lamborn cares to little about election fraud in our state". The court is allowed to apply a more lenient standard - known as substantial compliance - than the secretary's office. He says he doubts a federal court would step in and get in the way of a ruling on legal residency by the state's highest court.

A candidate can earn their way onto a major party's ballot either through petition signatures, or by getting support at the party's assembly.

His campaign spokesperson, Dan Bayens, said they expect to appeal the ruling at a federal level.

There are several other Republicans already on the primary ballot, and Lamborn has faced primary challenges before.

Stephany Rose Spaulding is the Democratic nominee for the seat.
