Google loses 'right to be forgotten' case

The cases were the first of their kind to be heard in England, and the ruling could have implications for criminals who want to remove information about a conviction from search engines.

The site must now remove historical articles about the man having committed crimes in his past.

Google only deletes information that appears on its own results pages.

This afternoon the judge announced his decisions in the two cases, which were both contested by Google, following separate High Court trials. The two businessmen claimed that it should apply to reports about their crimes, since their punishments had been served and they claimed they had now been rehabilitated.

Mr Justice Warby has made orders barring the men from being identified in media reports about the litigation.

A Google search brings up the information "through a few key strokes", undermining the law about such older convictions where a defendant has paid his debt to society, Hugh Tomlinson, a lawyer for one of the businessmen, said at an earlier court hearing.

The judge described Alfie's life as "profoundly unfair" but accepted medical evidence that showed further treatment was futile. His father has argued he should be able to take his 23-month-old son home as he approaches death.

At a high level, it refers to the right of people to either have certain adverse data about them blocked from being Internet accessible, or to have entries removed from search engine results on their names if the information in those entries is outdated or irrelevant.

Mr Justice Warby said the businessmen, who can not be named for legal reasons, complained about Google Search results which featured links to third-party reports about their convictions.

In that case the claimant had been convicted of conspiracy to account falsely and sent to prison for four years.

The court refused to award damages to the businessman, saying Google took reasonable care in the case.

The ruling judge, Justice Mark Warby, ruled in the petitioner's favor on Friday, and ordered Google to remove the relevant search results.

Immediately after the 2014 ruling, the founder of Wikipedia Jimmy Wales warned that Google must not be left to "censor history", warning that would be "a very risky path to go down".
