Gang member shot dead in court after he rushes witness stand

The footage shows the moment the defendant, Siale Angilau, a member of the Tongan Crips gang, getting up out of his seat, grabbing a pen, and running towards the witness stand before launching at him.

Authorities on Monday released video of a US Marshal shooting an accused gang member who attacked a witness with a pen inside the Salt Lake City Federal Courthouse. As the chaos unfolded, a U.S. Marshall identified in court documents as "Jane Doe" fired four shots at Angilau, 25, while instructing him to drop the pen.

As US District Judge Tena Campbell was escorted out of the courtroom, someone called 911 at the end of the released video.

The 24-second video recording shows Angilau charging towards a witness with a pen in hand.

The FBI also found the shooting to be justified.

Robert Sykes, the Angilau family's attorney, said a jury should see the video and make a decision about whether the marshal used appropriate force.

As someone yells, "whoa, whoa, whoa", but before any officers could react, Angilau sprinted toward the witness and leaped with his right arm cocked overhead with the pen in hand.

The witness he tried to attack was out of sight as his attacker was shot, and was not hurt in the incident. Warning: Viewers may find the video disturbing.

Angilau's family first filed the wrongful death lawsuit in 2014 - claiming he shouldn't have been shot because it was 'partially unreasonable, reckless and constitutionally excessive. He said it is up to the them to decide if they want to appeal the judge's ruling dismissing their lawsuit.

A judge dismissed an excessive force case against an officer after he shot and killed a defendant, who hurled himself at a witness who was testifying. Angilau was the last person to be tried, as previous defendants were sentenced to 10 to 30 years behind bars.

Magistrate Judge Paul Cleary ordered the release of a pixelated version of the video obscuring faces of law enforcement officers and others in November, but the Department of Justice objected.

The media coalition including KUTV and the AP fought for several years with government attorneys to have the video released publicly, arguing that the shooting raised questions about police use of force and upholding the principle of open courts.
