Google is being sued for the 2016 Pixel's microphone problems

Weeks claims that Google acknowledged that her phone was defective, but that it refused to refund her money or replace it despite the fact it was still under warranty, tech news site Ars Technica reports.

Google has been hit with a class action lawsuit in the United States for issues with microphone on the first-generation Google Pixel and Pixel XL smartphones.

"It promoted the Pixel phones as premium products and priced them from $649 to $869", plaintiffs Patricia Weeks from Florida and Waleed Anbar from California said. In fairness, Anbar wasn't within his one-year warranty period when he reported the problem to Google, having purchased the phone in December 2016 and reporting the issue in January of this year.

The issue as explained in the lawsuit reads, "The defect compromises the phone's core functionality, preventing consumers from communicating by voice call and from using features like Google Assistant".

Google did appear to take the original reports of microphone problems quite seriously past year, going so far as to replace phones which exhibited the issue.

Google is said to have blamed a "hairline crack in the solder connection on the audio codec".

In a class action complaint filed this week, plaintiffs allege that the microphones in their Pixel and Pixel XL phones were defective from the start and that Google knowingly sold faulty mobiles amid widespread complaints immediately after launch.The lawsuit adds that some warranty replacement phones continued to have problems.

Google's Pixel phones were the first of the company's handsets to be marketed as "Made by Google", in contrast to earlier "Nexus" phones that were openly designed by third-party firms.

Users are believed to have been told to either claim under warranty, or contact a service provider - including Dixons Carphone Warehouse in the UK.

This suit alleges that Google's replacement wasn't sufficient remedial action for those affected, though, as the replacement devices were capable of manifesting the same issues.
